  • attorny by the name of rorke said that communists still have to obey federal laws of the united states (they apply to american reds)
  • a communist secretory was arrested because he was secretory of the new york stae communist party(found in 1567 fulton avenue in the bronx)
  • socialists threat to join forces with the communists as a result to the raids they quote: the socialist party raises the voice of the empithetic and solem protest agianst america's activities raids etc.

  5. August Claessens -- Both, representing the eight in and seventeenth Assembly Districts in Manhattan

Cause:

Taken under a resolution introduced by Majority Leader Simon L. Adler and this resolution was supported and opposed by votes, giving the Majority Leader Simon L. Adler votes 140, supporting the idea. And the total number of people opposing to the resolution was 6. Those 6 people were 4 socialist members and 2 democrats from the Bronx, which were, William S. Evans of the fifth and J. Fairfax McLaughlin of the Eighth District.

  • 5 socialist members elected from districts in NYC go to the u.s capitol for an opening legislative session
(some men excluded from taking seat in the in the assembly body pending investigations by their judiciary committee on their membership qualifications)
  • the excluded men were Samuel A. Dewitt and Samuel Orr (Third and Fourth Bronx assembly districts)also Charles solomon(Brownsville district in Brooklyn) also Louis Waldman and August claessens(eighth and seventeenth districts in Manhattan)
  • the action of the house was taken under a resolution introduced by majority leader Simon L. Adler and was adopted by a vote of 140 to 6
  • 6 of those negative votes were made up of four socialists and 2 democrats from the Bronx

  • the socialists say that they intended to file the charges they were accused before the state legislature but they weren't permitted to do so

  • black had mentioned that the activities the socialists was doing wasn't focusing on the rich and poor violators like the democrats and republicans plan, raises were going to get increased for the police department (for deputy superintendent 2,500 to 3,000 dollars- for captains 1,800 to 2,400 dollars-for lieutenants from 1,500 to 1,800 dollars- 60 dollars for privates)
  • a bill designed to make good Friday a legal holiday was introduced by assemblyman J. Fairfax .McLaughlin Democrats of the Bronx

Threaten to Unseat Socialist Aldermen
JANUARY 17th 1920

  • Democrats and socialists combined to vote a request that the assembly can reconsider its suspension on the socialist members
  • The assembly said if the socialists continue to be unseated they will proceed to throw out of the board of aldermen
  • Aldermen vladeck (socialist) says that two years before the event, a conference was held by democratic members of the board as to weather the socialist members should be seated but no action was taken
  • Alderman Bruce M. Falconer (republican) admitted that he had drawn such a resolution but it was never presented the democrats refusing to agree
  • notice was made saying if the assembly succeeded to expel the socialist members, action to investigate socialist alderman would be taken by the republicans
  • president of the board and democratic majority wrangled with the republicans before the passage of the reconsideration resolution was laid down the prior week to this event
  • William J. Flynn commissioner of public works for the Bronx broke from his party and voted negative with the republicans

  • august claessens mad a speech the previous November (one of the suspended socialists) the speech contained incendiary and invective on the government and abuse of the American people
  • the speech was read before the assembly judiciary committee to determine if the five socialists can be restored of their assembly seats/to membership
  • the hearing was adjourned until the next Tuesday of the speech reading
  • the mass of evidence introduced had contained copies of the national and new york state constitutions of the spa (socialist party of America)
  • two of the defendants Claessens and Louis Waldman were affiliated with radical pamphlets and the membership cards of other socialist members
  • while claessens speech was being read into the record the chairmen martin had the occasion for the first time to rebuke sternly spectators from applauding the most incendiary utterances embodied into the speeches if this happens martin said to have the chamber cleared

  • Ramos says the actions of new york city were unconstitutional and all acts of the suspension were invalid
  • trying to propose these resolutions failed
  • it was predicted that these resolutions wouldn't be adopted
  • some republicans agree that the suspension is unconstitutional so there party had a dissension
  • there will be more resolutions proposed from both sides the next time the assembly meets

Refuse to Reseat Socialist Five
JANUARY 27th 1920

  • assembly again refuses to reseat pending the outcome of their trial before the judiciary committee
  • doing this ended the fourth futilt effort
  • the fight for the oppisition was lead by assemblyman william c. amos and joseph steinberg, (new york city republicans) and monroe bloch (democrat)
  • the trial was resumed the day after the article was written
  • the speaker directed chairman martin of the committiee to speed up the procceedings with a view, if possible of reaching a detrmination weather to give the seats to the suspended socialists
  • amos offered three more resoloutions which the speaker declared were not privileged and therefore could not be read one of them was relieved
  • another resolution was that the socialists were linked with an allen empire and were guilty of treason was mearly oratory or based on evidence
